1. USE OF PRODUCTS AND SERVICES

 

  • You may use any of our services, provided that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of United Kingdom, and the United States, or your jurisdiction of residence. In order to access any services, you are required to provide current and accurate identification, contact information, and other details as part of the registration process.

 

  • You are responsible for maintaining the confidentiality and accuracy of your account information, and you are responsible for all activities that occur under your account. You are solely responsible for all content on your account.

 

  • Torpix may cancel or suspend your access to the services at any time and for any reason without notice. Upon cancellation or suspension, your right to use the service will stop immediately. You may not have access to data that you stored on the service after we suspend or terminate the service. You are responsible for backing-up your data that you use with the service

 

 

2. ACCOUNT AND BILLING

 

CONTACT INFORMATION

  • Clients must provide their legitimate name and residential address when registering an account.
  • P.O. Boxes and non-residential or mail forwarding addresses are not accepted.
  • A Valid phone number is not required for registration.

 

INVOICING

  • Services with recurring billing will be due for payment on the first of the month.
  • Invoices for monthly recurring services will be issued 7 days in advance of the due date.
  • Unpaid services will be suspended 3 days past the due date on the service.
  • Unpaid services will be terminated 10 days past the due date on the service.

 

 

CREDIT

  • Account credit cannot be transferred from one client to another.
  • Existing account credit will automatically be applied towards further generated invoices until exhausted.

 

 

QUOTES

  • All quotes given are valid for 7 days.

 

 

BANDWIDTH CHARGES

  • Inbound bandwidth is FREE and is not counted towards your overall bandwidth allowance.
  • Once exhausted your outbound bandwidth allowance, then you will be charged £0.05 /GB.

 

 

REFUND POLICY

 

  • Hosting Services
    14 day money back guarantee, if you are unsatisfied with the service.

 

  • Admin Work & Web Services
    Once you’ve  agreed on the quote, and have paid. Not eligible for any form of refund.

 

  • Refund Eligibility
    Only first-time accounts are eligible for a refund. For example, if you’ve had an account with us before, canceled and signed up again, or if you have opened a second account with us, you will not be eligible for a refund. Violations of this Agreement will waive your rights under the refund policy.

 

 

 

3. BACKUP RESTORES

  • Each client gets one (1) FREE restore each calendar month.
  • Once your free restore is exhausted, It’s £5.00 /Restore

 

 

 

 

4. Acceptable Usage Policy

 

MALICIOUS CONTENT

  • Any type of script, code, or other file that performs harmful action, either to the user affected or as a bulk action triggered by the user.
  • Any content that violates United Kingdom or United States laws.
  • Knowingly permitting or hosting malicious content is grounds for immediate termination, and a permanent ban from any future service.

 

BANNED CONTENT

  • IRC
  • TOR
  • Pirated Software (Warez)
  • Hateful/Racist/Harassment oriented sites
  • Hacker focused sites/archives/programs
  • Trading Programs/Forex
  • Streaming live sporting events

 

 

 

 

 

5. GUARANTEE POLICYS

 

5.1 UPTIME GUARANTEE

  • Torpix provides a 99.99% uptime guarantee on all hardware, power and network connectivity. In any given month.
  • If your server is down for more than 0.1% ( 5 Mins ) in any given month, you will receive credit for the down-time.
  • Credit is automatically given within 24 hours of the incident.

 

Payouts

  • If downtime exceeds 5 Mins, then 5% account credit will be given.
  • If downtime exceeds the first hour, then 5% account credit will be given for every FULL hour.
  • Not exceeding 100% of your monthly base payment. ( Excludes dedicated IP’s, licences, add-on services and admin work )

 

NOT COVERED

  • “Downtime” is defined as failure of Core Networking Equipment, that directly results in network packet loss of 3.00% or greater. However, the definition of “Downtime” does not include any of the following:

    • Packet loss of less than 3.00%
    • Scheduled maintenance or Emergency Scheduled Maintenance of the servers or network.
    • Outages not reported by Torpix monitoring systems.
    • Problems with the Customers internet connectivity or problems with other internet providers’ connectivity outside of Torpix’s control.
    • Problems with Customer’s or any Third Party’s hardware, software, or access to the Internet, including, but not limited to, Third Party DNS issues.
    • Customer’s service is suspended due to terms violation(s).
    • Issues relating to Customer Data.
    • System administration, commands, or file transfers performed by Customer.
    • Act of god. ( Earthquakes, Floods, Volcanic Eruptions, Landslides or Hurricanes )

 

 

5.2 DEPLOYMENT GUARANTEE

  • Torpix provides gurenteed deployment of ( fully paid ) service within 4 hours.
  • If your service is not deployed within 4 hours of payment than 25% account credit will be given.
  • Credit is automatically given within 24 hours of the incident.

 

NOT COVERED

  • “Deployment” is defined as fully active service. However, the definition of “Guaranteed Deployment” does not include any of the following:

    • Full payment hasn’t been made.
    • Issues relating to fraud order(s)
    • Scheduled maintenance or Emergency Scheduled Maintenance of our support and billing system.
    • Power or network outage at our NOC ( Network Operations Centre )
    • If we’re designing a website for you. ( Service is activated once complete )
    • Custom setup. ( Depending on the request, please allow up to 12 hours )
